Amendment Rules, 1991

NOTIFICATION
New Delhi, 21st Feb., 1991
G.S.R. 84(E):-- In exercise of the powers conferred by sub-section (1), read with clauses (a) and (b) of sub-section (2) of section 74 of the Merchant Shipping Act, 1958 (44 of 1958), the Central Government hereby makes the following rules further to amend the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1987, namely :--
1. (1) These rules may be called the Merchant Shipping (Tonnage Measurement of Ships) amendment Rules, 1991.
(2) They shall come into force on the date their publication in the official Gazette.
2. In the Merchant Shipping (Tonnage Measurement of Ships) Rues, 1987.
(i) in rule 3, the following proviso shall be inserted at the end, namely :-
"Provided that in the case of ships of less than 20 metres in length, the gross tonnage (GT) may be determined by the following formula :
GT = 0.23 LBD
when L = length as defined in clause (m) of rule 2.
B= breadth as defined in clause (c) of rule 2.
D= moulded depth as defined in clause (O) of rule 2."
(ii) in rule 4, in sub rule (1) the following proviso shall be inserted at the end, namely :-
Provided that in respect of ships of less than 20 metres in length, the net tonnage (NT) may be determined by the following Formula :
NT = 0.20 LBD
Where 1= aggregate length of cargo spaces from bulk head to bulk head
B= breadth as defined in clause (c) of rule 2.
D= moulded depth as defined in clause (0) of rule 2.
Provided further that NT shall not be less than 0.30 GT."
(iii) In appendix IV, the following note shall be inserted at the end; namely :-
"Note:- Length, breadth and depth amidships to upper deck as defined in clauses (m), (c) and (o) of rule correspond to the length, breadth and depth amidships to upper deck as defined in paragraph (8) of Article, 2, paragraphs (3) and (2) of regulation 2 of the International Convention on Tonnage Measurement of Ships 1969 respectively."
