Merchant Shipping (Safety Convention Certificates) Rules, 1995

NOTIFICATION

New Delhi, the 2nd August, 1995

     G.S.R.517 (E) – Whereas a draft of the Merchant Shipping (Safety Convention Certificates) Amendment Rules, 1994 was published as required by sub-section (2) of section 299B,  Section 344 and clauses (d) and (e) of sub-section (2) of section 344-I of the Merchant Shipping Act, 1958 (44 of 1958) in the Gazette of India, Part-II, Section 3, sub-section (i), dated the 25th June, 1994 under the notification of the Government of India G.S.R. 303, dated the 8th June, 1994 for the information of all persons likely to be  affected thereby  inviting  their  objections and suggestions in respect  of the  said draft rules till a period of 30 days from the date on which copies of the notification  as published  in the Gazette of India are made available to the public.

     And whereas the  said Gazette was made available to the public on 25th June, 1994; 

     And whereas no objections or suggestions have been received; 

     Now, therefore, in exercise of the powers conferred by section 344 of the Merchant Shipping Act, 1958
(44 of 1958), the Central Government hereby makes  the following rules further to amend the Merchant Shipping  (Safety Convention Certificate) Rules. 1968, namely:- 

                                                                     RULES 

          1.     (1)
    These rules may be called the Merchant Shipping (Safety Convention
                         Certificate Amendment Rules, 1995. 

      (2)    They shall come into force on the  date of their publication in the Official Gazette.     

          2.      In the Merchant Shipping (Safety Convention Certificate) Rules, 1968 (hereinafter referred to
                   as the said rules), for rule 5, the following  rule shall be substituted namely :- 

        “5 . Forms of Certificate, Nuclear Passenger Safety Certificate, Nuclear Cargo Safety    Certificate, Passenger Ship Safety  Certificate, Cargo Ship Safety  Construction Certificate, Cargo Ship Safety Equipment Certificate, Cargo  Ship Safety Radio Certificate, and the Cargo Ship Safety Certificate,  shall be granted in duplicate in appropriate  form set out in the Second   Schedule with such modifications as may be necessary to show that   the ship in respect of which the certificate  is issued, complies with the  requirements of the  International Convention for the Safety of Life at   Sea, 1974 as amended from time to time”. 

           3.      In the Second Schedule to the  said rules, for all the forms the following  forms shall be
                    substituted  namely :-

2.2         the ship complied with the requirements of the  convention as regards structural fire  protection, fire       safety  systems and appliances and fire control plans; 

2.3         the life-saving  appliances  and the equipments of life-boats, lifecrafts and rescue  boats were provided in accordance with the requirements of the convention; 

2.4         the ship was provided  with a line-throwing  appliance and radio  installations used  in life-saving  appliances in  accordance with the requirements of  the Convention; 

2.5            the ship complied with the  requirements of  the Convention as regards  radio installation;  

2.6            the functioning of the radio installations used in life-saving  appliances complied  with the requirements of the Convention. 

2.7            the ship complied with the requirements of the Convention as regards shipborne navigational  equipment, means of  embarkation for  pilots and nautical publications; 

2.8            the ship was provided with lights, shapers,  means of making sound  signals and distress signals in accordance with the requirements of the Convention  and the International Regulations for Preventing  Collissions at Sea in force; 

2.9             in all other  respects  the ship complied  with the relevant  requirements of the Convention. 

3.       That an Exemption Certificate has/has not been issued.
