N O T I F I C A T I O N
(MERCHANT SHIPPING)
G.S.R. 382 :- Whereas a draft of the Merchant Shipping (Safety Convention Certificates) Amendment Rules, 1977 was published as required by sub-section (1) of section 344 of the Merchant Shipping Act, 1958 (44 of 1958), in the Gazette of India, Part II, Section 3, sub-section (i), dated the 10th September, 1977, under the notification of the Government of India No. GSR 1183, dated the 24th August, 1977, inviting objections and suggestions from all persons likely to be affected thereby till the 26th October, 1977;
And whereas the said Gazette was made available to the public on the 12th September, 1977;
And whereas no objection or suggestions have been received;
Now, therefore, in exercise of the powers conferred by section 344 of the Merchant Shipping Act, 1958 ( 44 of 1958), the Central Government hereby makes the following rules, namely:-
1. (1) These rules may be called the Merchant Shipping (Safety Convention Certificates ) Amendment Rules, 1978.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Merchant Shipping (Safety Convention Certificate Rules, 1968 (hereinafter referred to as the said rules), for rule 5, the following rule shall be substituted, namely :-
“5. Forms of certificates :- (1) Nuclear passenger ship safety certificate, nuclear cargo ship safety certificate passenger ship safety certificate, special trade passenger ship safety certificate, special trade passenger ship space certificate, cargo ship safety construction certificate, cargo ship safety equipment certificate, cargo ship safety radiotelegraph certificate, cargo ship safety radiotelephony certificate and exemption certificates shall be granted induplicate in the appropriate from set out in the Second Schedule. “
(2) Qualified passenger ship safety certificate, qualified cargo ship safety construction certificate, and qualified cargo ship safety equipment certificate shall be in one of the appropriate forms referred to in sub-rule (1) with such modifications as may be necessary to show in what respects the ship, in respect of which the certificate is issued complies with the requirements of the International Convention for the Safety of life at Sea, signed in London on the 17th day of June, 1960.
3. In the said rules, in the First Schedule, after item I and the entry relating thereto, the following items and the corresponding entries shall be inserted, namely :-
“IA For a special trade passenger ship safety certificate …………………………. Rs. 120.00.”
“IB. For a special trade passenger ship space certificate………………………. Rs. 120.00”
4. In the said rules, in the Second Schedule, for the form relating to “Passenger Ship Safety Certificate for an International Voyage in the course of which
a short
unberthed passengers are carried “, the following forms shall be substituted, namely :-

I, the undersigned, certify :-
I. That the above-mentioned ship has been duly surveyed in accordance with the provisions of the Rules annexed to the Special Trade Passenger Ships Agreement, 1971, applicable to a voyage within the Special Trade areas.
II. That the survey showed that the ship, when carrying special trade passengers and having on board a total number (Crew and passengers) not exceeding ……… persons, complied with the requirements of the said Rules as regards:-
(1) the watertight subdivision arrangements and details;
(2) the following subdivision loadlines :

III. That in all other respects the ship complied with the requirements of the Rules annexed to the said agreement so far as these requirements apply thereto.
This Certificate is issued under the authority of the Government of India. It will remaining force until ……………………… issued at ……………… the day of …………………. 19…………………..
The undersigned declares that he is duly authorized by the said Government to issue this Certificate.

NOTE :- It will be sufficient to indicate the year in which the keel was laid, or in which the ship was at a similar stage of construction, except for the year of the coming into force of the Special Trade Passenger Ships Agreement, 1971, in which case the actual date should be given.
In the case of a ship which is converted as provided in Rule 2 (14) of the Special Trade Passenger Ships Agreement, 1971, the date on which the work of conversion was begun should be given.
