EXTRACT FROM THE GAZETTE OF INDIA: PART II – SEC. 3, SUB-SEC. (i)

New Delhi, the 1st August, 2001 

            G.S.R. 431.—Whereas a draft of the certain rules further to amend the Merchant Shipping (Load Line) Rules, 1979, was published as required by Section 311 of the Merchant Shipping Act, 1958 (44 of 1958) with the notification of Government of India in the Ministry of Shipping No. G.S.R. 515, dated the 14^th December, 2000 at page 3807 of the Gazette of India, Part II, Section 3, Sub-section (i), dated the 23^rd December, 2000 inviting objections and suggestions from all persons likely to be affected thereby after the expiry of sixty days from the date on which copies of the Gazette of India in which the said notification was published, were made available to the public; 

And whereas the copies of the said Gazette of India were made available to the public on the 5^th January, 2001; 

And whereas  no objections or suggestions have been received from the public on the said draft;

             Now, therefore, in exercise of the powers conferred by Section 311 of the said Act, the Central Government hereby makes the following rules further to amend the Merchant Shipping (Load Line) Rules, 1979, namely:- 

1.(i)                   These rules may be called the Merchant Shipping (Load Line) Amendment Rules, 2001.  

(ii)                                   They shall come into force on the publications of these rules in the Official Gazette. 

2.         In the Merchant Shipping (Load Line) Rules, 1979 (hereinafter referred as to the said rules) in rule 2, after sub-rule (22), the following sub-rule shall be inserted, namely :- 

(22A) "Surveying Authority" means  a body of persons authorized under sub-section (1A) of Section 9 of the Act, to be surveyors.' 

            3.         In rule 9 of the said rules, for the words "Assigning Authority",  wherever they occur in-sub-rules (1) and (2), the words "Assigning Authority or Surveying Authority" shall respectively be substituted.
