GSR. 36 . ---- whereas a draft of the Merchant Shipping (Crew Accommodation ) Amendment Rules, 1998 was published, as required by subsection (1) of section 175 of the Merchant Shipping Act, 1958 (44) of 1958), at pages 112 to 127 in the Gazette of India, part II, Section 3, Sub-section (i) dated the 21st February, 1998 with notification number G.S.R. 43, dated the 10th February, 1998 inviting objections and suggestions from all person likely to be affected thereby within a period of forty-five days from the date on which the copies of such notification as published in the Gazette of India were made available to the public;
And whereas such Gazette was made available to the public on 21st February 1998.
And whereas no objection or suggestion have been received from the public on the said draft.
Now, therefore, in exercise of the powers conferred section 175 read with section 457 of the Merchant Shipping Act, 1958 (44 of 1958 ), the Central Government hereby makes the following rules, namely :-
1.(1) These rules may be called the Merchant Shipping (Crew Accommodation) Amendment Rules, 1999.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Merchant Shipping (Crew Accommodation) Rules, 1960 (hereinafter referred to as the said rules ), in rule 1, in sub-rule (3),--
(a) for the words “They shall apply to”, the words “Unless otherwise stated elsewhere in these rules, they shall apply to” shall be substituted;
(b) in clause (a), for the figures “200” the figures “500” shall be substituted;
(c) in the end, the following proviso shall be added namely:- “Provided that the provisions of these rules shall not apply to any ships playing in voyages of short distance, the members of crew of which are not required to stay on board overnight for period exceeding 8 hours.”
3.In the said rules, in rule 3, ---
(a) in sub-rule (1), after the figures :100” the words and figures “for ships under 200 metres in length and I in 200 for ships 200 metres in length and over” shall be inserted;
(b) in sub-rule, (2), in clause (a), for the figure “153”, the figure “100” shall be substituted.
4. In the said rules, in rule 4,---
(1) in sub-rule (1),__
(a) for the words “The Central Government may exempt from the requirements of this sub-rule” the words “The requirements of this sub-rule” shall not apply to” shall be substituted.
(b) In clause (g), for the word “if the words “Central Government” shall be substituted.
(2)in sub-rule (2) and the entries relating there to, the following shall be substituted, namely :-
“(2) in every ship of 1000 tons or over, the crew accommodation, other than store rooms shall be situated amid ships or aft as for as practicable. In no such ship any part of crew accommodation, other than store rooms, shall be located forward of the collision bulkhead.”.
5. In the said rules, in rule 5, ---
(a) sub-rule (1) shall be omitted;
(b) sub-rule (2) shall be renumbered as sub-rule (1).
6. In the said rule, in rule 6,--
(a) in sub-rule (1), for the world “watertight”, the word weatheright” shall be substituted;
(b) in sub-rule (5), the words “plywood or other” shall be omitted.
7. In the said rules, in rule 7.---
(a) in sub-rule (2), for the portion beginning with the words “The Central Government may exempt”, and endings with the words “and harbouring of dirt and vermin.” The words and brackets :Alternately, the underside of overhead deck shall be insulated with a material (other than wood) which complies with the requirements specified in the Third Schedule and which is so fitted as to avoid as far as possible absorption of water, condensation, transmission of noise and harbouring of dirt and vermin.” Shall be substituted.
8. In the said rules, in rule 9,---
in sub-rule (2),--
(i) in clause (e),--
(a) for the figures and words “500 tons or over” the words and figures “under 1000 tons” shall be substituted;
(b) the portion beginning with the words “The Central Government may exempt” and ending with the words “ have been made to ensure the safety of the crew” shall be omitted;
(ii) Clause (k) shall be omitted;
(iii) Clause (1) shall be omitted;
(iv) in clause (o), for the portion beginning with the words “The Central Government may exempt” and ending with the words “ oiltight under service condition shall be omitted.
9. In the said rules, in rule 10, in sub-rule (1), the portion beginning with the words “ The Central Government may exempt” and ending with the words “With other suitable means of heating” shall be omitted.
10. In the said rules, in rule 11.--
(a) in sub-rule (1),--
(i) for the world “lockers and store rooms” the words “lookers sanitary accommodation, passageways, offices and store rooms” shall be substituted:
(ii) the portion beginning with the words “The Central Government may exempt” and ending with the words “is unreasonable or impracticable in the circumstances. “ shall be omitted;
(b) in sub-rule (3) the words “passenger ship”, the word “ship” shall be substituted;
(c) in sub-rule (5), the portion beginning with the words “the Central Government with the word s “ The Central Government may exempt” and ending with the words “provided in the crew accommodation” shall be omitted;
(d) for sub-rule(6) the following sub-rule shall be substituted, namely :-
(6) The electric lighting in way of the following spaces, that is to say, sleeping rooms, day rooms, recreation rooms, rooms for watching films and television, hobbies and games rooms, mess rooms, hospital words, offices, studies, sanitary accommodations, laundries, drying rooms, dry provision, store rooms, cold store rooms, galleys, passageways, companionways and covered deck recreation spaces shall be adequate for the purpose of this rule if :-
(a) the lamps, paintworks and other surface finishes are new, the illuminance in the horizontal plane when measured at the point specified in respect of that space in the Forth Schedule is steady and is maintained subject to tolerance of 10 per cent at the value prescribed in that schedule in respect of these points; and
(b) it complies with any other requirements specified in the Forth Schedule in respect of that space,”
11. In the said rules, in rule 12,
(a) in sub-rule (1), after the words “store room”, the word “laundry, drying room, galley, pantries and sanitary accommodation” shall be substituted;
12. In the said rules, in rule 12A,--
(a) in sub-rule (1), after the words “store room’, the words “laundry, drying room, galley, pantries and sanitary accommodation” shall be substituted;
(b) in sub-rule (2), --
(i) in clause (a), for the words “ satisfactory temperature and relative humidity as compared to outside air conditions”, the words and figures “temperature of 28 degrees Celsius with 50 per cent relative humidity when the ambient temperature is 35 degree Celsius 70 per cent relative humidity” shall be substituted;
(ii) in clause (b), for the words “a sufficiency of air changes in all air conditioned spaces” the words and figures “eight air changes per hour in any mess room or recreation room and six air changes in any other room, the amount of the re-circulated air not exceeding 50 per cent at any stage” shall be substituted.
13. In the said rules, in rule 13,--
(a) in sub0-rule 3, for the portion beginning with the words “ Provided that no scupper shall be required” and ending with the words “for sole use of one persons” shall be omitted.
14. In the said rules, in rule 14,--
(a) in sub-rule (1), the words “and white or light in colour” shall be omitted;
(b) in sub-rule (2), the words “lime wash or” shall be omitted.
15. In the said rules, in rule 15, in sub-rule(3), the words “on the ship’s structure. The markings shall be cut into the or otherwise marked in a equally permanent manner” shall be omitted.
16. In the said rules, in rule 16.--
(A) in sub-rule (2), ---
(i) in clause (a),---
(a) in sub-clause (iv), the words “of the deck department other than petty officers” shall be omitted;
(b) sub-clauses (v) and (vi) shall be omitted ;
(ii) clause (b) shall be omitted :
(B) In sub-rule 3,---
(i)in clause (b), the words and figure “wherever practicable 1 person per room and in no event, more than” shall be omitted;
(ii) in clause (e), the words and figure “Wherever practicable 1 person per room and in no event, more than” shall be omitted;
(iii) for clause (f) the following clause shall be submitted namely :-
“(f) Other ratings - Not more than 4 persons per room in a cargo ship of under 1000 tons and not more than 3 persons per room in a cargo ship of 1000 tons or over and not more than 6 persons per room in a passenger ship.”
17. In the said rules, in rule 17, ---
(a) in sub-rule (5),---
(i) in clause (a), after the words “centimetres of” the words “non-insulated” shall be inserted;
(b) for sub-rule (7), the followings sub-rule shall be substituted m\namely :-
“(7) Beds shall be in a single tier, except in a room which there is no side scuttle or in which there is any side scuttle, if fitted, is fitted clear of the beds”.
(c) in sub-rule 8,--
“(i) in clause (c) sub-clause (i) shall be omitted;
(d) in sub-rule (10), after the word ”vermin” the words “alternatively a suitable resilient mattress fitted on a suitable ventilated base may be provided” shall be inserted.
“18. Furniture and fittings in sleeping rooms. – In every ship of 1000 tons gross and over, furniture and other equipment shall be provided in sleeping rooms in accordance with the scale and description prescribed in the Sixth Schedule.”
19. In the said rules, in rule 19.---
(a) in sub-rule (1), for the figures “100” the figures “1000” shall be substituted;
(b) in sub-rule (2), the portion beginning with the words “the Central Government may exempt” and ending with the words “impracticable in the circumstances” shall be omitted.
(c) For sub-rule (3), the following sub-rule shall be substituted, namely:-
“(3) In every ship of 1000 tons or over, the mess room provided for the ratings and petty offices shall be separate from those provided for the officers of the ship”.
(b) sub-rule (5) and sub-rule (6) shall be omitted.
20. In the said rules, in 20--
(a) for sub-rule (4), the following sub-rule shall be substituted, namely :-
“(4) (A) In every ship to which these rules apply, the following equipment shall be fitted in every mess room or in a pantry readily accessible at al times by the crew using the mess room or adjacent to it, or, in the case of ship under 1000 tons in a galley:
(a) a dresser or side board [which may be the storage locker referred to in clause (a) of sub-rule (3)] ;
(b) a hot press (except in ships of under 1000 tons);
(c) a sink;
(d) supply of cold drinking water;
(e) means of beating drinking water for hot beverages; and
(f) electric toaster :
Provided that :-
(i) in a mess room provided for officers and petty officers a side board shall be provided in the mess room itself;
(ii) the hot press need not be provided in any ship with a centralized messing system where a section of the galley is fitted out as pantry or servery with food being provided through serving hatches incorporating bainmaries or hot press .
(B) The equipment referred to in the clause (A) shall be adequate in size for the number of persons using the mess room.
21. In the said rules, in rule 21,---
(a) in sub-rule (1),---
(i) for the figures “ 3000” the figures “8000” shall be substituted;
(ii) for the words employed otherwise than on a home trade voyage, “a smoking room” the words, “a recreation room” shall be substituted:
(iii) for the word smoking the word “recreation” shall be substituted;
(b) sub-rule (2) shall be omitted,
(c) in sub-rule (5) the words and figures “being a ship of 500 tons or over” shall be omitted;
(d) in sub-rule (7), clause (iii) shall be omitted.
22. In the said rules, in rule 22 ---
(a) for the figures “3000” the figures “8000” shall be substituted
23. In the said rules in rule 23. --
(a) In sub-rule (I), the provision shall be substituted by the following provisions namely :-
“Provided that in ship of under 8000 tons, petty officers and ratings other than petty officers shall be treated as one class for the purpose of this rule”.
(b) in sub-rule (9),---
(i) for the words ‘Spring loaded draw-off taps”, the word “taps” shall be substituted;
(ii) for the figures “500”, the figures – “1000” shall be substituted.
24. In the said rules, in rule 24,---
(a) for sub-rule (2), the following sub-rule shall be substituted, namely :-
“(2) Hot and cold fresh water shall be laid on to al wash basins, baths and showers fitted in compliance with these rules.
Provided that in the case of a bath and shower combined, hot and cold fresh water shall be required to be laid on only to the bath or the shower and cold fresh water shall be laid on to any wash basins which are additional to those required by these rules and are fitted in sleeping rooms”.;
(b) in sub-rule (3), the brackets and words “ (whether salt or fresh)” shall be inserted ;
25. In the said rules, in rule 25, -
(a) in sub-rule (2), after the words “taps in” the words “or possibly near” shall be inserted;
(b) after sub-rule (3), the following new sub-rule shall be added, namely:-
“(4) The storage, filling and distribution arrangements for drinking water shall be such as to prevent any possible contamination. A dry space such as cofferdam shall be provided between drinking water tanks and other tanks such as oil tanks and sewage tanks. Drinking water tanks shall not contain any piping other than that necessary for the carriage and distribution of drinking water. Air, filling and sounding pipes shall stand sufficiently above the deck.”
26. In the said rules, in rule 26, --
(a) in sub-rule (1);
(i) for the figures “500”, the figures “1600”, shall be substituted;
(ii) before the words “The troughs or other facilities shall be situated the words and figures “in ships of 3000 tons or over”. Shall be inserted;
(iii) the portion beginning with the words “in the provision of a separate laundry”, and ending with the words “served by a mechanically operated suction pump”, the words “when the provision of a separate laundry is unreasonable or impracticable in the circumstances. The troughs or other facilities shall be provided with an adequate supply of hot and cold fresh water and shall be so arranged as to discharge overboard.” Shall be substituted:
(b) in sub-rule (2), for the words “In every ship to which these rules apply” the words and figures “In ships of 3000 tons or over” shall be substituted;
(c) in sub-rule (3), for the words “In every ship to which these rules apply” the words and figures “ In every ship of 1000 tons gross or over” shall be substituted.
27. In the said rules, in rule --27
(a) in sub-rule (1) for the proviso the following proviso shall be substituted, namely :-
“Provided that for ships under 1600 tons, petty officers and ratings other than petty officers shall be treated as one class for the purpose of this rule.”;
(b) in sub-rule (9), ----
(i) in clause (a), in sub-clause (ii), the words and figures “with an opening of 10.2 centimetres a the front” shall be omitted;
(ii) in clause (e), after the words “by an efficient and “ the words “hygienic system. If required under the provisions of Pollution Regulations necessary arrangements to be provided for the treatment and discharge of sewage,” shall be substituted;
(c) in sub-rule (10),----
(i) for clause (g), the following clause shall be substituted, namely :-
“(g) An arrangement for flushing.”,
(ii) for clause (i), the following clause shall be substituted, namely :-
“(i) Each such water closet shall be provide with a fresh water tap.”.
28. In the said rules, in rule 28,----
(1) Sub-rule (3) shall be omitted;
(2) In sub-rule (4), the portion beginning with the words “The Central Government may exempt and ending with the words “requirements of this sub-rule” shall be omitted ;
(3) sub-rule (5) shall be omitted ;
(4) sub-rule (6) shall be omitted;
(5) sub-rule (8) shall be omitted;
(6) in sub-rule 14---
“(i) in clause (a),
(a) for sub-clause (i), the following sub-clause shall be substituted, namely :-
“(i) an oven of adequate capacity”:
(b) for sub-clause (ii), the following sub-clause shall be substituted, namely :-
“(ii) a cooking range of adequate capacity by with combined electrical load of not less than 0.5 KW for each member of the crew.”;
(ii) clause (b) shall be omitted.
29. In the said rules, in rule 29, in sub-rule (5),---
(a) after the words “shall adjoin a galley or machine casing” the words “unless dry provision room adequately insulated” shall be inserted, the portion beginning with the words “ The Central Government may exempt” and ending with the words “is adequately insulated” shall be omitted.
30. In the said rules, in rule 30, for sub-rule (1) the following sub-rule shall be substituted, namely :-
“(1) in every ship, means shall be provided to store perishable provision. In ships of 3000 tons or over, refrigerated cold rooms of adequate capacity shall be provided for this purpose. In ships of under 3000 tons refrigerators or box freezers may be located in a dry provision room or galley or any other suitable place close to galley.”
31. In the said rules, in rule 31, ---
(a) in sub-rule (1), for the words “Every ship to which these rules apply being a ship the words “Every foreign going ship of 1600 tons or over” shall be substituted;
(b) for sub-rule (6) the following sub-rule shall be substituted, namely:-
“(6) Every permanent hospital shall be fitted on at least on one side with a side scuttle of 30 cm in diameter. Side scuttle shall be capable of being opened and provided with curtain, blinds of jalousies. The requirement of side scuttle shall not apply if the permanent hospital is artificially lighted and fully air conditioned or served by a trunked mechanical ventilation system.”;
(c) sub-rule (7) shall be omitted;
(d) sub-rule (17) shall be omitted;
32. In the said rules, in rule 32, sub-rule (5) shall be omitted.
33. In the said rules, after rule 39, the following rule shall be added, namely:-
“40. Application of rules to ships under 500 tons gross and above 200 tons gross and above 200 tons gross – The provisions of rule 3, sub-rules, (1), (2) and (5) of rule (6), sub-rule (1) of rule (7), sub-rule (1) of rule 8, sub-rule (1) of rule 9 , sub-rules (1) and (5) of rule 11, sub-rules (1) and (4) of rule 12, sub-rules (1) and (2) of rule 13, rule 14, rule 15, sub-rule (1) of rule 16, sub-rule (1) of rule 17, sub-rule (1) of rule 19, sub-rules (1),(2) (3) and (5) of rule 20, sub-rule (1) of rule 24, sub-rule (1) of of rule 25, sub-rule (1) of rule 27, sub-rule (1) of rule 28, sub-rule (1) of rule 29, sub-rule (1) of rule 30, sub-rules (1), (2) and (3) of rule 33, sub-rule (1) of rule 34, rule 35, rule 36, rule 37, rule 38 and rule 39 shall also apply far as practicable to sea going mechanically propelled ship of under 500 tons gross and above 200 tons gross as they apply to ships of 500 tons gross or over. “
34. In the said rues, in the Third Schedule,---
(a) after sub-paragraph (d) the following sub-paragraph shall be added, namely:-
“(e) In every ship regularly engaged on voyagers in the Tropics or the Persian Gulf, if any part of the deck above the crew accommodation is exposed to the sun, additional insulation should be provided underneath such deck, taking into consideration the heat transmission that would otherwise take place to such parts due to solar radiation.”
35. In the said rules, Fourth Schedule shall be renumbered as the Fifth Schedule and before the said Schedule so re-numbered and after the Third Schedule, the following shall be inserted, namely:-
“FORTH SCHEDULE”

“General Measurement Points” means, in relation to any space those points which measured at a height of 850 mm above the floor fall on an imaginary line drawn vertically through the following points :-
(a) every point mid way between every 2 adjacent lamp in that space.
(b) Every point mid way between and lamp and any position on the boundary of that space to which that lamp is nearer than any other lamp; and
(c) Where any part of the space available for free movement is shielded from the direct rays of a lamp by a re-entrant angle formed in the boundary of that space the central point of the space so shielded.
(A) Sleeping Room and Day Rooms;
(1) At general measurement Points 50 lux
(2) At every seat at a writing desk of table 200 lux
(3) At every seat at writing desk or table 250 lux
(4) At not less than half the seats (other than
those mentioned (3) above )in a sleeping
room provided for use of more than one person 150 lux
(B) Mess Rooms:
(1) At general measurement Points 100 lux
(2) At every table and sink 150 lux
(C) Recreation Rooms (including for watching films and television hobbies and games room)
(1) At general measurement Points 50 lux

(4) At not less than half the seats other than
those mentioned in (3) above 150 lux
(D) Hospital Wards :
(1) At general measurement points 50 lux
(2) At any wash basin 100 lux
At least one fixed lamp shall be installed in addition to the electric reading lamp required by sub-rules (5) of rule
(11) to be provided at the head of each bed.
(E) Offices and Studies:
(1) At general measurement points 100 lux
(2) At every seat writing desk or table 200 lux
(F) Sanitary Accommodation ( including sanitary accommodation in hospital)
(1) At general measurement points 100 lux
(2) At any mirror 200 lux
(G) Laundries
(1) At general measurement points 100 luz
(H) Drying room
(1) At the center of space 50 lux
(I) Galleys (including bakeries and pantries):
(1) At working positions 300 lux
The light shall be so disposed as to ensure that food preparation tables range tops serving table s and washing up sink receive the maximum amount of light.
(J) Dry provision Store Rooms and cold Store Rooms:
(1) At general measurement points 100 lux
The lights shall be so disposed as to ensure that shelves and cupboards receive the maximum amount of light.
(K) Passage ways companionways and covered deck recreation spaces:
(1) At general measurement points 50 lux
A light shall be placed
(a) at the head of each stairway, ladder and hatchways; and
(b) at or near the doors of lockers provided for oilskins or working clothes.
36. In the said rules after fifth Schedule the following schedule shall be added namely :

Note :
1. The wardrobe shall be fitted with a shelf not less that 20 Cm and not more than 40 Cm below its top and with fittings on which the clothes may be hung.
2. The rack for drinking water bottle and tumblers may be fitted inside the cabinet for toilet requisites.
3. The wash basin to be made of vitreous China or other durable material and should have an efficient means of draining. A splash board shall be provided for a wall above the wash basin.
4. In every sleeping room which accommodates more then one member of crew, every drawer, locker and wardrobe shall be provided with means of locking.
5. In ships under 1600 tons gross --
(a) drawer volumes may be reduced by on-half ;
(b) wardrobe sectional area may be reduced by one-thirds;
(c) requirement of settees may be dispensed with; and
(d) requirement of wash basins in petty offices sleeping rooms may be dispensed with.
6. For sleeping rooms with attached private wash rooms, items such as wash basin and toilet cabinet may be provided inside such was room”.
