Merchant Shipping (Certificates of Competency) Rules, 1989

NOTIFICATION
New Delhi, the 2nd June 1989 

                G.S.R. 591 (E):- In exercise of the powers conferred by section 87 read with section 81 of the Merchant Shipping Act, 1958 (44 of 1958), and in supersession of the Mechant Shipping (Certificates of Competency) Rule, 1961 the Central Government hereby make the following rules, namely :- 

1.                   Short title and commencement: (1) These rules may be called the Merchant Shipping (Certificates of Competency) Rules, 1989. 

(2)        They shall come into force on 4-10-89 

2.                    Definitions:- In these rules. Unless the context otherwise requires,- 

(a)                 "Act" means the Merchant shipping act, 1958 (44 of 1958);

(b)                 "Certificates" means a certificate of competency granted under section 79 of the Act. 

3.                    Form of certificates: A certificate of competency for any grade referred to in section 78 f of the Act shall be in the appropriate from set out in the schedule annexed to these rules. 

4.                    Certificates to be numbered: All certificates for a  grade shall be numbered serially and prefixed by such identifying letters as may be allotted by the Director General. 

5.                    Record of duplicate copies :- (1) Every certificates shall be made in duplicate and,- 

(a)                 the original copy of the certificates shall be delivered to the person entitled to it;

(b)                 The duplicate copy of the certificate containing a note of all orders referred to in section 82 of the act shall be kept in the office of the Director-General. 

(2)                 The particular of every certificate issued under these rules and a notes of all orders made for concelling, suspending, altering or otherwise affecting any certificate shall be entered in a register to be kept in the office of the Director-General.

Therefore, the Certificate will only remain valid for sea-going service in the highest rank appropriate to it for 5 years form the date on which it is confirmed below or overleaf that the holder has satisfied specified requirements for the continued proficiency and up-dating of knowledge for certificated engineer officers.

 

                However, the Certificate always remains valid for sea-going service in the ranks below the highest appropriate to it ..
